The following description is based upon an actual case in which a patient initiated legal action after suffering a complication subsequent to an invasive diagnostic procedure performed by a senior fellow. Named as codefendants were the senior fellow, attending physician, and the hospital. Because any hospital with house staff is potentially vulnerable to similar litigation, Ethics Committees at Work is addressing the questions raised by this dilemma.

In 1924The Classical Quarterlypublished a note by Alexander Haggerty Krappe titled ‘Euripides’Alcmaeonand the Apollonius Romance’. Drawing attention to the obscure origins of the ancient Greek and Roman novels in general and pointing out the scholarly agreement on the role love plays in both the ancient novels and Euripidean tragedy, Krappe observed that ‘Euripides was drawn upon for whole episodes in order to enrich the plot of the [ancient] novel’. She raises two important questions: How should we understand what is going on in these accounts? and What are the implications of these reports for our understanding of what it is to have a 'sense of self' or a 'sense of agency'—of 'subjectivity' generally—which might have, both, clinical and nonclinical implications?What does it mean to have a self or a sense of having one, agency or a sense of having it? Bioethics coverage of the recent Ebola outbreak neglected the ethical issues associated with aspects of the outbreak having environmental significance. The neglect of environmental dimensions is symptomatic of the way that the current institutionalization of bioethics as a field of inquiry separates medical and environmental expertise. As visionaries who are recognizing the need for better integration of human and veterinary medicine with environmental health are starting to call for “One Health”, it is now time to recognize the need for “One (...) Issues of social justice underlie the clamour for greater gender balance in top-management. The present study reveals that pursuit of such social justice is also value-enhancing in relation to the longer-run performance of initial public offerings stocks, especially where female board members are unencumbered by family-connection with other directors. This study examines the economic benefits of board gender diversity for state- and privately controlled firms in the Hong Kong IPO market. Gender board diversity is much less common in state-run IPO (...) firms. Within the subset of privately controlled IPO firms, distinction exists between entities that accommodate family-connected board officers and those that do not. Specifically, this study focuses on family-ties between board members. This issue allows for finer-grained assessment of family influence on firm performance. Stronger post-listing stock, return-on-assets and sales-on-assets performance arise in privately controlled firms without family-connected board members and in state-run entities. Gender diversity thus serves as a positive, but only when female director presence is untrammelled by family associations between directors. However, there is little evidence of a link between female board representation and IPO underpricing. Relative to state-backed issuers, privately controlled firm boards accommodate more women, younger officers and a broader mix of nationalities, but appear more-inclined to unify CEO and chair positions. Board duality, the fraction of independent directors and directors’ age and nationality exhibit little relation with initial and aftermarket stock returns. In prescriptive terms, minority investors gain from the inclusion of female directors, especially when IPO firm directors are unencumbered by family-affiliation with other board members. Results therefore add to the clarion of calls for greater female board presence. (shrink)

Paul Thompson’s excellent book, From Field to Fork: Food Ethics for Everyone, argues that contemporary food ethics persistently ignores the nature and actual impact of GMOs, Concentrated Animal Feeding Operations, food aid to developing countries, and more. On Thompson’s view, such philosophical analyses must incorporate empirical knowledge. Additional strengths of Thompson’s book: its attention to quality-of-life issues, its openness to the concerns of the marginalized, and its emphasis on the interconnectedness of problems in food ethics. I raise one area (...) of disagreement with Thompson: his treatment of GMOs is, I argue, insufficiently skeptical. I suggest a three-fold revision of the book’s treatment of the precautionary principle, and I levy an additional argument against GMOs, the Inductive Argument. Using the herbicide Roundup as a case study of the ways in which industry urges the use of technologies that have not been fully vetted or monitored, I argue that products originally seen as safe often turn out instead to be harmful to the environment and health. Significant inductive experience with similar cases gives people additional reason to be even more suspicious of GMOs than Thompson suggests. (shrink)

It's important (...) because general conceptions of what kinds of things we treat (e.g., disorders of the heart, brain, or mind) guide practice by specifying what constitutes, nurtures or poisons them, ways they may break apart or be repaired and processes that produce change, as well as by helping to draw appropriate boundaries between psychiatry and other fields. It's difficult because psychiatry comprises many kinds of objects, theories and forms of practice (primarily biomedical, psychodynamic and cognitive behavioral), and we don't know which, if any, are 'natural' or valid. It's also not established whether or why all or any should be called, 'psychiatric,' what explains their being so-called (if it is correct to do so), or which may be fundamental or constitutive and which derivative and potentially eliminable.One appealing answer (the Diagnostic and Statistical Manual of Mental Disorders [DSM] an swer; American Psychiatric Association, 2013) to the question of what makes something psychiatric is that it is mental in some essential way. A practical treatment of psychiatric disorder," Joseph Gough (2023) addresses these problems with two bold proposals: first, that we abandon altogether using 'mental' (assuming we understand its meaning) in the definition of 'psychiatric disorder,' and, second, that we, instead, define psychiatric disorders as those conditions best treated by psychiatrists (including psychologists, social workers, nurses and other practitioners).To a psychiatrist, these proposals seem, both, a welcome validation of our work ("At last, someone appreciates us!"), but also a troubling destabilization of how we understand that work ("That can't be right: it's backwards!") Philosophical food ethics or deliberative inquiry into the moral norms for production, distribution and consumption of food is contrasted with food ethics as an international social movement aimed at reforming the global food system. The latter yields an activist orientation that can become embroiled in self-defeating impotency when the complexity and internal contradictions of the food system are more fully appreciated. However, recent work in intersectionality offers resources that are useful to both philosophical and activist food ethics. For activists, intersectionality (...) provides a way to preserve and strengthen the meaningfulness of protest and resistance, even in the face of complexity and uncertain outcomes. For philosophers, intersectionality chastens the tendency to regard moral problems as inherently solvable, and provides a way use tensions inherent in food system reform as a source of ethical insight. Justice for food workers and small farmers has joined the rising tide of concern over the impact of industrial agriculture on food animals and the broader environment, all while a global epidemic of obesity-related diseases threatens to overwhelm modern health systems. An emerging worldwide social movement has turned to local and organic foods, and struggles to exploit widespread concern over the next wave of genetic engineering or nanotechnologies (...) applied to food. Paul B. Thompson's book applies the rigor of philosophy to key topics in the first comprehensive study explore interconnections hidden deep within this welter of issues. Agricultural crops developed using the tools of genetic engineering have become socially institutionalized in three ways that substantially compromise the inherent potential of plant transformation tools. The first is that when farming depends upon debt finance, farmers find themselves in a competitive situation such that efficiency-enhancing technology fuels a trend of bankruptcy and increasing scale of production. As efficiency increasing tools, GMOs are embedded in controversial processes of social change in rural economies. The United States, at least, has chosen not (...) to undertake policy interventions to slow or reverse this trend. The second institutionalization of GMOs is found in the way that agricultural science has become divided between two camps, one focused on efficiency and total global production, the other focused on maintaining soil and water ecosystems in the face of both population growth and climate change. GMOs have been strongly supported by the first camp and regarded as irrelevant to the goals of the second. Finally, GMOs have become symbolic markers in the global debate over neoliberal institutions for trade and the protection of intellectual property. While there may be agronomic arguments for favoring GMO technology, the way that it has become situated in each of these social debates insures that it will be subject to strong opposition without regard to its biological risks and potential benefits. Commodification and Secondary Rationalization.

There are now dozens of proposals for integrating ethics into the early planning and assessment of technological innovation. This paper tracks some of Larry Hickman’s contributions to these trends. While Hickman’s suggestions could be incorporated into virtually many of the new proposals for integrating ethics into technological research, development and dissemination, barriers remain. In this paper, I will explores some reasons why the field remains fragmented, emphasizing weaknesses in the pragmatist approach. First, I acknowledge the significance of obvious explanations: the (...) technical community’s unfamiliarity with ethical inquiry and the lack of both administrative and financial commitment to ethics-oriented research. There is, in short, an epistemic gap between the message that innovators are prepared to hear and the sophisticated response that Hickman’s pragmatism offers. This gap may be a practical limitation to philosophical pragmatism in many of its manifestations. (shrink)

Thompson provides commentary and reaction to other chapters in the book. It is organized as sections identified by the names of chapter authors. Thompson responds to chapters advancing new ideas in agriculture by indicating how he understands the authors’ analysis with respect to his own work. Chapters that address more philosophical dimensions of Thompson’s writings are addressed by clarifying the pragmatist orientation of Thompson’s thought. Michel Foucault’s metaethics is used as a basis for explaining pragmatist ethical pluralism.

Four strands of research in the philosophy of technology have made important contributions to environmental philosophy. First, critical theory of technology emphasizes the environmentally exploitative tendencies of capitalist technological innovation. Second, phenomenologyhas examined how technologies shapeperception and orientation to the world with implications for our treatment of and regard for nature. Third, concurrent with the environmental movement itself, an empirical turn in philosophy of technology resulting in philosophers focusing their attention on particular tools and techniques. Empirical studies have emphasized environmentally (...) significant technologies. Finally, work inspired by philosophy of science has adopted scientific reasoning and methods in environmental policy with tools such as risk analysis and environmental impact assessment. Richard P. Haynes, founding editor of _Agriculture and Human Values_, was an Associate Professor in the Department of Philosophy at the University of Florida. His personal interests in the environmental dimensions of agriculture led him to found the journal in the 1980s with support from the W.K. Kellogg Foundation. Later in life, he published on ethical treatment of lab and farm animals. Haynes understood _Agriculture and Human Values_ as a broadly multidisciplinary and interdisciplinary platform for critical studies of agriculture and (...) food systems. As he took over the editorship of _The Journal of Agricultural and Environmental Ethics_ in the 1990s, he fashioned it as a complementary outlet for more traditionally philosophical studies of environmental and agricultural topics. The Spirit of the Soil challenges environmentalists to think more deeply and creatively about agriculture. Paul B. Thompson identifies four `worldviews' which tackle agricultural ethics according to different philosophical priorities; productionism, stewardship, economics and holism. He examines current issues such as the use of pesticides and biotechnology from these ethical perspectives. This book achieves an open-ended account of sustainability designed to minimise hubris and help us to recapture the spirit of the soil.

Bioethics is currently witnessing unprecedented debate over the moral and legal norms governing the conduct of clinical research. At the center of this debate is the duty of care in clinical research, and its most widely accepted specification, clinical equipoise. In recent work, we have argued that equipoise and cognate concepts central to the ethics of clinical research have been left unnecessarily vulnerable to criticism. We have suggested that the vulnerability lies in the conspicuous absence of an articulated foundation in (...) moral and legal theory of the physician-researcher's duty of care to the patient-subject. We have repeatedly suggested that the requisite foundation is in the ethics of trust and the law of fiduciaries.Curiously, despite the absence of a published thorough exposition of our position, some have preemptively criticized our suggestion that the relationship between physician-researcher and patient-subject is fiduciary. Others have offered their own accounts of the implications of fiduciary law for the relationship. (shrink)

The term ‘responsible AI’ has been coined to denote AI that is fair and non-biased, transparent and explainable, secure and safe, privacy-proof, accountable, and to the benefit of mankind. Since 2016, a great many organizations have pledged allegiance to such principles. Amongst them are 24 AI companies that did so by posting a commitment of the kind on their website and/or by joining the ‘Partnership on AI’. By means of a comprehensive web search, two questions are addressed by this study: (...) Did the signatory companies actually try to implement these principles in practice, and if so, how? What are their views on the role of other societal actors in steering AI towards the stated principles? It is concluded that some three of the largest amongst them have carried out valuable steps towards implementation, in particular by developing and open sourcing new software tools. To them, charges of mere ‘ethics washing’ do not apply. Moreover, some 10 companies from both the USA and Europe have publicly endorsed the position that apart from self-regulation, AI is in urgent need of governmental regulation. They mostly advocate focussing regulation on high-risk applications of AI, a policy which to them represents the sensible middle course between laissez-faire on the one hand and outright bans on technologies on the other. The future shaping of standards, ethical codes, and laws as a result of these regulatory efforts remains, of course, to be determined. (shrink)

brook muller begins his contribution to the Coss Dialogues by contesting and at least partially deconstructing Le Corbusier’s aphorism “a house is a machine for living.” He then trades upon an ambiguity that masks the difference between watersheds that mark an important transition from one phase to another and those that are defined by the drainage area associated with a body of water. The 2015 Coss Dialogues took place in the watershed of the Grand River, which extends from its southeast (...) limit near Jackson, Michigan, through my home in Lansing before emptying into Lake Michigan near Grand Haven, some 40 miles to the west of Grand Rapids. Agrarian political philosophies since ancient Greece stress the role of agriculture in forming political solidarity and civic virtue. More recent transformations suggest a way to conjoin these elements of what makes a polity politically sustainable with environmental sensitivity and literacy.

Presents a collection of essays written over a period of 15 years by agricultural ethicist Paul B. Thompson. The essays address the practical application of ethics to agriculture in a world faced with issues of increased yield, threatened environment, and the disappearance of the family farm.

: When may a physician legitimately offer enrollment in a randomized clinical trial (RCT) to her patient? Two answers to this question have had a profound impact on the research ethics literature. Equipoise, as originated by Charles Fried, which we term Fried's equipoise (FE), stipulates that a physician may offer trial enrollment to her patient only when the physician is genuinely uncertain as to the preferred treatment. Clinical equipoise (CE), originated by Benjamin Freedman, requires that there exist a state of (...) honest, professional disagreement in the community of expert practitioners as to the preferred treatment. FE and CE are widely understood as competing concepts. We argue that FE and CE offer separable and, in themselves, incomplete justifications for the conduct of clinical trials. FE articulates conditions under which the fiduciary duties of physician to patient may be upheld in the conduct of research. CE sets out a standard for the social approval of research by institutional review boards. Viewed in this way, FE and CE are not necessarily competing notions, but rather address complementary moral concerns. (shrink)

Algorithmic decision-making based on profiling may significantly affect people’s destinies. As a rule, however, explanations for such decisions are lacking. What are the chances for a “right to explanation” to be realized soon? After an exploration of the regulatory efforts that are currently pushing for such a right it is concluded that, at the moment, the GDPR stands out as the main force to be reckoned with. In cases of profiling, data subjects are granted the right to receive meaningful information (...) about the functionality of the system in use; for fully automated profiling decisions even an explanation has to be given. However, the trade secrets and intellectual property rights (IPRs) involved must be respected as well. These conflicting rights must be balanced against each other; what will be the outcome? Looking back to 1995, when a similar kind of balancing had been decreed in Europe concerning the right of access (DPD), Wachter et al. (2017) find that according to judicial opinion only generalities of the algorithm had to be disclosed, not specific details. This hardly augurs well for a future right of access let alone to explanation. Thereupon the landscape of IPRs for machine learning (ML) is analysed. Spurred by new USPTO guidelines that clarify when inventions are eligible to be patented, the number of patent applications in the US related to ML in general, and to “predictive analytics” in particular, has soared since 2010—and Europe has followed. I conjecture that in such a climate of intensified protection of intellectual property, companies may legitimately claim that the more their application combines several ML assets that, in addition, are useful in multiple sectors, the more value is at stake when confronted with a call for explanation by data subjects. Heated debate surrounds the question whether the relationship between physician-researcher and patient-subject is governed by a duty of care. Miller and Weijer argue that fiduciary law provides a strong legal foundation for this duty, and for articulating the terms of the relationship between physician-researcher and patient-subject.

In this article we argue that the emergence of a new form of organization – community enterprise – provides an alternative mechanism for corporations to behave in socially responsible ways. Community enterprises are distinguished from other third sector organisations by their generation of income through trading, rather than philanthropy and/or government subsidy, to finance their social goals. They also include democratic governance structures which allow members of the community or constituency they serve to participate in the management of the organisation. (...) Partnerships between corporations and community enterprises therefore raise the possibility of corporations moving beyond philanthropic donations toward a more sustainable form of intervention involving long-term commitments to communities. At the same time they change substantively the nature of any collaboration by allowing relationships to proceed on the basis of mutual advantage, thereby broadening their appeal and scope. In doing so, partnerships build capacity and enfranchise communities in a way that avoids the paternalism that has traditionally characterised relationships between corporations and voluntary sector organisations. Power relations are transformed because partners are seen as sources of valuable assets, knowledge and expertise, rather than recipients of patronage or charity. (shrink)

The role of Amartya Sen's early work on famine notwithstanding, food security is generally seen as but one capability among many for scholars writing in development ethics. The early literature on the ethics of hunger is summarized to show how Sen's Poverty and Famines was written in response to debates of past decades, and a brief discussion of food security as a capability follows. However, Sen's characterization of smallholder food security also supports the development of agency in both a political (...) and an economic sense. Economic agency is discussed and tied to longstanding literatures on the moral significance of farming within political economy. Finally, while the newly emergent literature on food sovereignty includes many themes, it is shown to be re-articulating arguments that stress smallholder's economic agency as a development goal. This pattern of argument thus provides a way to reconcile at least some of the claims being advanced under the banner of food sovereignty with the human development.. (shrink)
